Business-use terms for the Schengen Tracker web platform and Android driver application.

These Terms and Conditions ("Terms") govern the use of the Schengen Tracker platform, including the web application, Android mobile application, Schengen 90/180-day calculations, country and border-transition detection, notifications, support services, reports, and related functionality (the "Service").

Schengen Tracker is intended primarily for business use by transport companies, fleet operators, dispatchers, employers, and other organizations managing professional drivers.

By creating an organization, inviting users or drivers, activating tracking, or otherwise using the Service, you confirm that you have read, understood, and agreed to these Terms.

If you use Schengen Tracker on behalf of a company or other organization, you confirm that you are authorized to accept these Terms on behalf of that organization.

1. Purpose of Schengen Tracker

Schengen Tracker is a software tool designed to assist transport companies and drivers with monitoring and organizing information relevant to the Schengen 90/180-day rule.

The Service may process or use information including:

  • manually entered travel history;
  • entry and exit dates;
  • driver information;
  • detected country information;
  • GPS or device-location information;
  • possible country or border transitions;
  • historical stays;
  • automatically generated Schengen calculations;
  • information entered by organization owners, admins, dispatchers, or drivers.

Schengen Tracker provides informational and operational assistance only.

It is not an immigration authority, border authority, government service, legal adviser, or official travel-authorization system.

2. No Guarantee of Schengen Calculations

Schengen Tracker attempts to calculate used and remaining Schengen days based on information available to the Service.

However, we do not guarantee that any calculation is always complete, accurate, current, or accepted by an immigration or border authority.

Calculations may be affected by:

  • incorrect or incomplete historical information;
  • missing entry or exit dates;
  • GPS inaccuracies;
  • delayed synchronization;
  • missing location samples;
  • device restrictions;
  • Internet problems;
  • software errors;
  • incorrect user input;
  • delayed or missed border detection;
  • operating-system behavior;
  • other technical circumstances.

Users and Organizations must independently verify important travel and immigration decisions when necessary.

3. User-Provided Information

The accuracy of Schengen Tracker depends partly on the information entered by users.

If incorrect, incomplete, duplicated, outdated, or misleading information is entered, the resulting calculations may also be incorrect.

Users and Organizations are responsible for reviewing and correcting their information where appropriate.

Schengen Tracker is not responsible for incorrect results caused by information supplied by a driver, dispatcher, admin, organization owner, or other authorized user.

4. Location Data and Country Detection

Schengen Tracker may technically process GPS or other device-location information where necessary to determine:

  • the country in which a driver is located;
  • possible country changes;
  • possible Schengen entry or exit events;
  • information relevant to Schengen 90/180-day calculations.

Schengen Tracker is a compliance-support tool, not a surveillance tool.

The Service is not designed to provide employers or Organizations with continuous detailed monitoring of:

  • a driver's exact route;
  • private stops;
  • private visits;
  • personal movement history;
  • movements unrelated to Schengen compliance.

Location information is used primarily to determine country presence and possible transitions relevant to Schengen compliance.

5. GPS and Border Detection Are Not Guaranteed

GPS and automatic country or border detection are technical assistance features.

They must not be treated as official or infallible evidence of a person's physical location or border crossing.

Detection may be delayed, inaccurate, incomplete, unavailable, or incorrect because of factors such as:

  • GPS accuracy;
  • device model;
  • Android restrictions;
  • battery optimization;
  • disabled location services;
  • permissions;
  • tunnels or buildings;
  • poor satellite visibility;
  • Internet or network availability;
  • Force Stop;
  • phone restart;
  • app removal;
  • manufacturer-specific background restrictions;
  • device malfunction;
  • synchronization delays.

A missed automatic border crossing does not mean that the crossing did not occur.

An automatically detected crossing does not constitute official proof that the crossing occurred at the exact time displayed by the Service.

6. Offline Operation

The mobile application may temporarily store location or travel information on the device while Internet access is unavailable and attempt to synchronize it later.

Offline information may be lost or fail to synchronize due to:

  • application removal;
  • cleared application data;
  • damaged device storage;
  • phone reset;
  • permission changes;
  • operating-system restrictions;
  • device failure;
  • other technical problems.

Schengen Tracker does not guarantee that all offline information will always be successfully recovered or synchronized.

7. Organization Responsibility

For these Terms, an "Organization" means the transport company, fleet operator, employer, or other business that creates a Schengen Tracker workspace.

Each Organization is responsible for ensuring that its use of Schengen Tracker in relation to its own drivers complies with applicable laws and internal company requirements.

Where required by applicable law, the Organization is responsible for informing its drivers that location information may be processed for country detection and Schengen compliance purposes.

Schengen Tracker must not be used by an Organization for unlawful or covert surveillance.

The Organization remains responsible for its own relationship with its drivers and employees.

8. Driver and Device Responsibility

Drivers and Organizations are responsible for maintaining an appropriately configured device, including where relevant:

  • location services;
  • GPS;
  • background-location permissions;
  • Internet/mobile data;
  • battery settings;
  • required Android permissions;
  • compatible operating system.

Schengen Tracker cannot guarantee identical performance on every Android device.

9. Notifications and Warnings

Notifications, warning indicators, remaining-day values, GREEN/YELLOW/RED statuses, OVER LIMIT statuses, and similar features are convenience features.

Schengen Tracker does not guarantee that:

  • every warning will be generated;
  • every notification will be delivered;
  • every notification will be seen;
  • warnings will always arrive before a relevant event.

Users remain responsible for reviewing their compliance information independently.

10. No Substitute for Official Records

Schengen Tracker does not replace:

  • passports;
  • visas;
  • residence permits;
  • passport stamps;
  • official border records;
  • Entry/Exit System records;
  • official immigration databases;
  • government calculators;
  • immigration decisions;
  • professional legal advice.

If information in Schengen Tracker conflicts with an official authority or official record, the official determination should be independently reviewed and relied upon as appropriate.

11. No Legal or Immigration Advice

Nothing in Schengen Tracker constitutes legal, immigration, employment, tax, transport, or other professional advice.

If a person is uncertain about their right to enter, remain in, work in, or travel through a country, they should consult the relevant authority or qualified professional.

12. Service Availability

We aim to maintain a reliable Service.

However, we do not guarantee uninterrupted or error-free availability.

The Service may be unavailable or affected by:

  • maintenance;
  • updates;
  • hosting outages;
  • database failures;
  • Internet problems;
  • mobile operating-system restrictions;
  • third-party services;
  • network providers;
  • security incidents;
  • force majeure;
  • other circumstances beyond our reasonable control.

13. Software Errors

Software may contain errors.

Schengen Tracker may experience:

  • calculation errors;
  • synchronization errors;
  • GPS errors;
  • country-detection errors;
  • border-detection errors;
  • delayed data;
  • display errors;
  • notification failures;
  • other software defects.

Use of the Service means accepting that technical errors are possible.

14. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, Schengen Tracker, its owners, operators, developers, affiliates, and service providers shall not be liable for losses or consequences resulting from reliance on the Service.

This includes, where legally permitted, consequences arising from:

  • incorrect Schengen-day calculations;
  • incorrect used-day or remaining-day values;
  • inaccurate GPS information;
  • incorrect country detection;
  • missed or delayed border-crossing detection;
  • incorrect historical information;
  • incorrect user-entered information;
  • delayed synchronization;
  • lost offline data;
  • device problems;
  • Android operating-system restrictions;
  • Internet or mobile-network failures;
  • unavailable or delayed notifications;
  • Service downtime;
  • software bugs;
  • decisions made based on information displayed by Schengen Tracker.

To the maximum extent permitted by law, Schengen Tracker shall not be liable for resulting:

  • fines or penalties;
  • denied entry or exit;
  • immigration or border decisions;
  • visa or residence consequences;
  • detention or administrative proceedings;
  • travel disruption;
  • transport delays;
  • missed deliveries;
  • employment consequences;
  • business interruption;
  • loss of income;
  • loss of revenue;
  • loss of business opportunities;
  • indirect, incidental, consequential, special, or similar losses.

All decisions based on information displayed by Schengen Tracker remain the responsibility of the User and/or Organization.

Nothing in these Terms excludes or limits liability where such liability cannot legally be excluded or limited.

15. User Decisions and Responsibility

A GREEN, YELLOW, RED, OVER LIMIT, remaining-days value, border event, or similar result displayed by Schengen Tracker is a software-generated informational result.

It does not constitute permission or authorization to:

  • enter a country;
  • remain in a country;
  • leave a country;
  • work in a country;
  • cross a border.

Users and Organizations remain responsible for independently complying with applicable immigration, visa, border, residence, employment, transport, and travel requirements.

16. Account Security

Users are responsible for protecting:

  • passwords;
  • login credentials;
  • devices;
  • account access;
  • authentication methods.

Organizations are responsible for managing access granted to owners, admins, dispatchers, and other authorized users.

17. Plans, Driver Limits, and Billing

Schengen Tracker may offer different subscription plans and driver limits.

Some plans may limit the number of active or invited drivers that an Organization can maintain.

Pricing, limits, features, and plan availability may change over time.

Where billing is handled through invoices or bank transfer, the Organization is responsible for paying invoices according to the stated payment terms.

An Organization may be marked as PAST_DUE or SUSPENDED where applicable subscription obligations remain unpaid.

Suspension may restrict access to certain Service functionality.

Historical information may remain preserved during suspension where supported by the Service.

18. Support

Schengen Tracker may provide customer support through the platform, email, or other available support channels.

Any stated response time, including a target such as 24 hours, is an operational target and does not constitute a guaranteed service-level agreement unless separately agreed in writing.

19. Third-Party Services

Schengen Tracker may rely on third-party technology and infrastructure including hosting, databases, mobile operating systems, email providers, networks, geographic data, and notification services.

Problems or restrictions affecting those third-party systems may affect Schengen Tracker.

Schengen Tracker is not responsible for failures caused solely by third-party systems outside its reasonable control, subject to applicable law.

20. Suspension and Termination

Schengen Tracker may suspend or restrict access where reasonably necessary, including in cases of:

  • non-payment;
  • misuse;
  • unauthorized access;
  • security risks;
  • fraud;
  • unlawful use;
  • violation of these Terms;
  • attempts to interfere with the Service.

21. Changes to the Service

Schengen Tracker may modify:

  • features;
  • calculations;
  • algorithms;
  • supported devices;
  • plans;
  • pricing;
  • technical requirements;
  • mobile application requirements.

Users may be required to install updated versions of the mobile application to continue using certain functionality.

22. Privacy

Use of Schengen Tracker may involve processing personal and location information.

Processing of personal information is also subject to the Schengen Tracker Privacy Policy.

The Privacy Policy should be read together with these Terms.

Acceptance of these Terms does not eliminate any rights or obligations that apply under applicable data-protection law.

23. Changes to These Terms

These Terms may be updated to reflect:

  • product changes;
  • legal requirements;
  • security requirements;
  • billing changes;
  • new functionality;
  • business practices.

Where appropriate or required, Organizations may be asked to accept an updated version of the Terms before continuing to use the Service.

24. Acceptance of Terms

By selecting "I have read and agree to the Terms and Conditions" and creating an Organization, you confirm that:

  • you have read these Terms;
  • you understand these Terms;
  • you accept them on behalf of yourself and, where applicable, your Organization;
  • you understand that Schengen Tracker is an informational compliance-support tool;
  • you understand that Schengen Tracker is not an official immigration or border authority;
  • you understand that calculations may be inaccurate;
  • you understand that GPS and country detection may fail or be delayed;
  • you understand that technical problems may occur;
  • you accept responsibility for independently verifying important travel and compliance decisions.
